UAE considers new laws to prevent Ex-pats from leaving after loan defaults
The UAE Central Bank is considering tough measures including setting up a Dispute Resolution Committee to look into cases against loan defaulters, in a bid to help lenders ride out the current economic situation. Defaulters could find themselves blacklisted - which in the case of foreigners will also include them being prevented from leaving the country. A blacklisted person could face a number of difficulties in either working, doing business in the UAE, or seeking future finance.
The news comes as the number of bounced cheque offences rises in various sectors of the economy amid payment delays, which are hampering cashflow and some developers in Dubai are seeing high default rates. Many small and medium businesses see their running capital drying up as bank deposits shrink. Some are already facing difficulty paying their workers.
Many individuals are facing insolvency as their credit card limits are being lowered by banks and charges are on the increase, as banks seek to protect themselves.
Needless to say, the banks welcomed the news although they agreed that in many cases, jailing loan defaulters isn't the solution because then the recovery of their money becomes almost impossible. They acknowledged that a large percentage of borrowers haven't intentionally defaulted, but are victims of the current global financial crisis which has hampered their ability to pay back their bank loans on time.
In these cases, they said the defaulters must be given more time to repay their loans and that the proposed Central Bank mechanism would be of help as it would enable defaulters to explain their exact financial position and allow them to give banks a timeframe within which they would repay their debts.
Commenting on the UAE Central Bank initiative, Jeremy Parrish, chief executive of Standard Chartered Bank for Abu Dhabi and Al Ain, said that "as long as the bank's position is not compromised and as long as the law of the land is upheld, it seems to be a good move."
We predicted this move a few weeeks ago after Kuwait introduced a new law preventing in-debt foreigners from leaving the country and if you are a Brit waiting for April 1st before flying home, you may want to reconsider that - I suspect this law will be rushed through ASAP.

With the onset of the global financial crisis, most expats are made redundant or otherwise cut on the wages. Though some expats do not have the intention to leave the country, most of them are forced to do so because of the numerous calls and threats that they received from the bank collectors. The banks should be more lenient and flexible. We do pay for the interest charges, credit shields, etc. for any late payments, but still they are too harsh and rude. As long as the intention is there to pay, do not force your client to beg, steal or borrow just so they could make the payment required.
Banks dont care about people, its business out of the interest and hidden charges their putting on their loans & credit cards. You pay the minimum its like your just maintaining your current balance coz next billing the extra amount will be eaten away by service charge, credit sheild, insurance blah blah blah, and alte payment fees… deafulting on payments they will call your mobile, call your office, and be warned to file case against you, that you have until such time this day to pay.. huh slowly thier killing people…killing thier families as well..
Why not make some solutions, like to restructure or ask the borrower how much he can pay, better than not paying at all..slowly they can gather some funds.. much better than forcing people to leave the country.
People who are left behind, and that are willing to pay and settle all thier loans are threated hurshly with no respect, being theated like an animal or criminals. I hope bank will sort out solutions in helping the people that can help them as well.. not by scaring people and throw them to jail. In this time of crisis certain measures should be done not by maiking another laws for defaulter but rather remidies to ease the burden of willing payers.
We are also the victim of the global financial crisis, due to that we couldnt pay to our loans on time for more than 3 months, but the bank put my husband in jail and we are in streets now, our business is closed, we are forced to vacate the house and these bank ppl are harassing everyday by coming home, calling and threatening over the phone using abusing words. I request all the banks, most of the business runs on loans and you are taking interest and all the blah blah for that, please check the genuinity of the person, dont say that it is our duty to file a case, instead check the persons ability to pay back the loan, allow him to work and get it, ppl who are genuine and want to pay back, like those ppl only are suffering like my husband and his family is in streets now.
Unfortunately – the laws in most countries favor the banks. I do not see the point in jailing some one for non-payment of a loan.
“Punishment ” does not make any sense to me. It certainly won’t get the loan repaid.
i presently reside in qatar and i have also an oustanding loan its 6 months i was not able to pay the monthly dues and dont have any job i was retrenched from my company last dec. 2008. for it is better for both parties the debtors and the lender (banks) to help its other .the defaulter is not at fault when he cannot service his monthly dues when he is jobless .if the debtors can find a job then he can continue paying his loans any amount possible. so there must a coordination from the bank , from the authorities to help the hopeless individual to find some relief but not threatening them . anyway they stay in the country where the bank can count them and as an assurance that the debtors stay because he willing to pay his loan , the must give whatever support to ease their sufferings .
I have been in U.A.E. for more than 5 years and have an account and credit cards in H.s.b.c. bank and R.B.S. banks.
I have been a very good customer and my approximate expenditure was approx 5 to 7 k per month in terms of interest and other charges along with the minimum 5%
which means the banks were collecting around 40 to 50 k dirhams as interest and service charges
but now during the recession when I defaulted payment due to unpaid salaries the collections department staff are bawling and calling me a cheat, fraud and put me in jail.
The worse part is that all these persons are also expats who have come here for earning a living who can understand the grievences.

Can someone here willing to help me?I lost my job after my termination to my previous company which was the reason for my unpaid credit cards.I was able to find a job, got my employment visa but was not able to get residence visa as bank filed a case against me. I tried to talk to them but insult and a cold treatment was all i got.I am willing to pay that is why I did my best to find a new job however, rejection is what I get. Now, I do not know what to do. I hope someone here can help me out as I am just considering to surrender myself in the police. My chance of paying now is unclear as the company withdrew their offer as they cannot issue me a residence visa
Hi,I’m also a victim of recession in UAE and I was decided to leave UAE as my last resort.I was looking for a job after my retrenchment unfortunatety I didn’t found any.My previous company they didn’t did any cancellation of my visa as consideration for me. I was a good payer after my layoff for about 4 months. I know my responsibility and still thinking about it in a right time.

Cheques in the UAE is part of the slavery system which are implemented to control people , when you enter the country you need sponsor to live,eat or work , and this sponsor is your company or your guarantee cheques.
Banks are not very keen to recover their money since they will automatically get it back from insurance companies once they take legal action agains you and throw you in jail .
Their main task is to make example out of you and ensure that other slaves will never dare and do the same mistake that you did .
UAE legal system is a copy of the UK and US system in the 17 and 18 century and you are treated like a nigre slave no matter what is your nationality, education or position ( you are disposible at any time , and you will be trated like any other creminal by police and in jail ) the best example is what hapen to business men and large companies CEO who are spending time for bounced cheques crime (there is thousand of them in dubai jails )
i want to tell tht if anybody who is working or capable of taking loan or credit card please dunt take y i m telling this because banking world is a very bigger mafia. specialy in uae the banks are like mafia first they call you everyday sir take a credit card or a loan and then when you take it start using it and you pay monthly dues and u r a very good client we give you this and tht but i tell this all is fraud this is nothing because if you dunt trust me just check your credit card statments you will know tht you had paied over your card limit you know something over and over you just are paying like shit to them as many cards you have you just working for them only.

Dubai rules are very rigid. Do not go to jail.Go home as early as possible.

Highly unlikely I would think. The banks have no authority outside their country, nir does the Dubai police. Unless it is billions?

I bought a off-plan apartment in Abu Dhabi. I have paid 15% so far. The next installment is overdue, but due to the drop in value it’s not worth me continuing to make installments.
I am willing to walk away from the property.
I recenty received a letter stating that the developer will seek to reclaim the property but under contract I have to pay a further 10% or legal action may be started.
I did not take out a mortgage, so banks are not involved, and now live in the UK.
What is likely to happen?
Will legal action be taken or is it more likely that they are just going through the process to take the proprty back?

Will the bank have the right to put me into hold departure due to my loan? I don’t have any delinquency but I was just terminated with my job. The amount that was freeze in my bank is more than enough to amortize my loan for up to 10 months. Our company will rehire me when the new project will start in 3 months time after the Ramadan giving me more chance to continue paying my loan.
This doesnt look like a problem but im afraid they might stop me in the immigration as i hinted from one of the bank agent when i went in their office to explain…

The credit shield is all bull sh*&t, another way for companies in UAE to make money. The Credit shield comes with all sorts of clauses which people fail to read before taking loans. One advice to all people in UAE, if you still have a job and paying off your loans and want to leave UAE. Please leave it now, although u get paid good in UAE, there’s never a Diginified life. You have to live a Dog’s life, without changing your job, no learning and a financial crisis driven society. Please get out asap to your country, no matter if you would need to pay off the debts ur entire life, atleast u wont die a undignified death in alien country. Live like a king in your own country.
u all guys, why the fuck are you all scared of these UAE banks, i took credit card of almost all the banks in uae, had a lavish life style, including parting in bur al arab with these credit cards.
I enjoyed myself in dubai, what i did was just pay the minimum amount due. and finally one day after spending more than 2 years in dubai and living life king size, just left dubai, because from the day one i landed here, i knew that this is the place i dont want to spend my life, so i took all the benefit of these fucking banks.
I last when left dubai 1 year ago had credit card and personal and auto, loans of almost Dhs 850000/-.
The company where i was the senior project manager, were giving me Dhs 45000/- salary plus paying for apartment in jumeira, even now that company wants me back and are ready to pay all my loans and see that i have no problem in coming back to dubai.
but i dont want to be in this stupid country, where you have no rights or whatsoever, how ever qualified and exprienced you may be, these unliterate arabs think that we are their slaves and they are superioir to us,

help!i left uae early this year and have left an outstading balance on my fgb credit card. i have just recently received a letter from a law firm here in our country saying that i need to pay my balance in 3 days,surprisingly amounted to almost AED90,000 (incl interest) otherwise i will be convicted in court here back home and was told that interpol has been looking for me. is this true? is this possible?
i admit that i was a delinguent payer due to the financila crisis back there as our allowances and benefits had been cut. so there was no option for me but to leave has the banks had been harrasing me.

I was not able to pay the minimum amount for the last 3 months but i have been paying 5% of what is due. now they want to deposit my security cheque for non-payment reasons. can I sue the bank if they deposit my cheque? u wont b in trouble over tere,,,,ok.the bank gives contract to debt collection agencies..and u dont have to worry bout tht….but make sure,tht u never go back in gcc countries,,coz there will be a blacklist.if u r in ur home country,,then the banks cant do anything.coz u signed d cheque here and its not valid in other country.interpol is not after small defaulters..maybe they will sue u if u have millions or billions of unpaid debt..interpol has other serious matters to do.lol..if u still not comfortable,,get a lawyer and file a case against the debt recovery agency trying to threaten u.

I am one of those who is defaulting due to losing my job during the recession period and the banks are refusing to restrutcure my home finance in my favour and i have negative equity close to AED 1m.
So I had no choice but to escape and I did. I now live in another country and far away from the GCC.
My advice to anyone is to stay away from the GCC. I am a Muslim but have humanity. The GCC arabs think of all others as slave labour and treat us the same accordingly. They areruthless and put you behind bars so that your friends and family will get together and try and bail you out. The process of taking blank cheques and bouncing it is ridiculous and pre-historic. My advice to all fellow asian sub-continent people is to stay in your home country or work in another region. Stay away from the UAE especially. They have so many people in prison and once you are inside they treat you badly.
my husband work for more than 6 years in uae, he got back home coz he resigned from his work for 9 months now, FGB always send demand letters thru his mail that he has to pay his outstanding balance of 17,140.85dhs. The content of the mail is that “for your information you have already a Police Case in UAE and planning to forward the case thru International Police” i don’t think so that Interpol will after on small amount? how about those people owe them a big amount of money that worth in millions? Its better that we need to see and talk to a lawyer so that we lightened up our minds and free from worries.

15 Years in UAE, twice awarded the best employee, dedication in work..all these did not help me when I was displaced. The order came right at the time of global financial recession and I was left with a full credit card and a bank loan and no way to pay them off. Tried searching for some jobs but to no avail since the recession was at its peak. Then I was left with no options but to leave the country without informing the bank because the fools put you behind the bars. I used to pay regularly till that time. I even had my final dues sent to the bank directly. I had given my correct contact details of my permanent address. Will you call me a cheat?
The guys from the RAK bank called me a cheat and told me that they at last managed to trace my location ( with the address and contact number I gave them). They harassed me by sending some of their local contacts to my residence. I tried reasoning that it was on the basis of my salary they had issued the card( which i didn’t want but they kept pestering me continuously by pleading that they have to meet sales target) But it fell on deaf ears. Then I told them that they can do any thing they want, be it legal or off the way, to collect their money but then I cant give them a penny because I don’t have it and the next time they send someone to my residence they will meet my lawyers and the cops and will file a defamation and attempt to manhandle case.
I did this not because I didn’t want to pay them but because I am jobless and couldn’t afford to pay them and I hope god will be with me.

dont worry cool down, banks cannot do anything. They just keep threatening you. No extradition treaty, plus for interpol to get into this bankers have to deposit 500,000k. so relax. but guys like u getting scared gives upper hand to collection agency and banks. we have to pay but on the basis if we have a decent job then only and on the same basis only these dumbo banks issued credit cards/loans on job basis only and not on any property. jobs in gulf is like winds in desert, no certainaity, just bubble economy and shalll perish as bubble. very sad

in 2009 I took a loan from banks credit cards and due to global financial crisis i had lost my money and bank was too much calling and threating me to put me in jail and punish me so I become totally confused so I decieded to get exit from uae. now I gathered some amount and trying to start bank payment through easy installment but the immegration imposed me entry ban. so how it would be payment start and how would earn money to pay bank untill I get entry in uae.
the rules are not flexibal who wish to pay bank their amounts.
Okay, so here is the deal on the loans/credit cards etc. While people were leaving in droves early on in the economic crisis, it has actually doubled since. There are a couple of things you should know. If you come from a developed country, you most likely understand that banks collectors located in the UAE can not do anything once you leave. As long as there laws are based on sharia law and ancient customs, no developed country would extradite, and no country on the planet extradites for credit cards or personal loans. Can you imagine the bureaucracy? Governments have more to worry about. Second, if you live in a developing or underdeveloping country they still can’t do anything. People look at the middle east as the most backwater place on earth. In all cases, someone in your home country would have to purchase the loan from the bank in the UAE, which would be at an enormous discount, and then would have to seek payment from you. All you have to say is no. By the time they buy the loan at discount it is 20% of its original amount, then when you say no they would have to get a lawyer and got to court, basically costing them 30% of what you probably owe. Finally, you need to understand that these people attempt to collect with scare tactics but actually have no power. Screw them. Don’t worry about it, just never come back. And don’t listen to anyone here about what is moral or right, just don’t come back.
The UAE will learn the hard way, after all they believe in the hard way.

Its really feel secure and relief amoung defaulter family, I was also badly affected by damn global crises that made me defaulter of approx. 9 Bank Credit Cards as well as 2-3 loans – in the city that cares – how to make troubles for common man ( Dubai ).
I flew back to my home land since 2 years. and since then, i have been approached by many barking dogs ( Third party Recovery agents ) but THEY CANT DO ANY THING.
So this is my humble request to all of them , who are suffering from xtreme credit crunch please leave that country at the earliest before landing urself in JAIL. I assure you that you will take a long breath and definately feel like a heaven.

Everyone !!! avoid fgb and to think they have won awards 2 years in a row for being the best banks . Just visit the jails in the uae . Most of them are fgb defaulters … may Allah be as harsh with them as they are with their customers .

Specially Sharjah police is worst police in the whole world. They are just like animals. They do not care who is who. A highly qualified person is also suffering with a highly low category criminal persons in Sharjah Jail.
In one small room in all police stations in Sharja, they put more then 200 people. Most of them are young and innocent. Sharjah police is getting money from Saudia and Abu Dhabi for prisoner. If they are getting 1000 they spend 50 only. This is 100% business of UAE GOVERNMENT TO ARREST THE PEOPLE AND GETTING MONEY LIKE A BEGGAR. THEY DONT CARE ABOUT ISLAM, THEY DONT CARE ABOUT HUMANITY. THE WORST POLICE, WORST HUMAN RIGHTS AND WORST LAW IS IN UAE. THEY ARE HIGHLY UN EDUCATED BADOOS. UAE BANKS AND UAE POLICE HAS ALREADY DESTROYED MILLION OF PEOPLES BECAUSE OF THEIR POLICIES AND WORST LAWS.
I lived in UAE seven years with my family.
I am a high qualified and experienced person belong to a very good family. In 2005 in Sharjah, I bought one two bed room appartment with bank loan, becuase I had very good job that time for 14,000 Dhm per month. Later on due to global financial crises value of the property very much fall down and I sold out that appartment becuase i Lost my job as well. I gained alot of loss on that propertly also No job and with family and kids, school going. My only two instalments were short and NBD opened police case and I went into the jail. Bank asked me to pay full amount, and later on they agreed for 100,000 dhm in one short, that amount from selling appartment I paid to bank and I came out after 15 days from jail. I lost my all respect, my credibility and every thing becuase of that incident. later on I found job after six months and again bank opened police case, So four time i went into the jail. During my best job in one very big oil company I resigned and left UAE with two hundred Dhm in my pocket. I hate UAE AND I HATE UAE BANK. THEY FINISHED MY LIFE MY FAMILY LIFE. THERE ARE NO HUMAN RIGHT EVEN SINGLE PERCENT IN UAE. THEY ARE JUST LIKE ANIMALS. IN UK, US, CANADA THERE IS NO ANY LAW LIKE THIS TO PUT THE PERSON IN JAIL. IF THE PERSON IS IN JAIL THEN WHO WILL PAY THE MONEY BACK TO BANK.
I AM DEEPLY REQUESTING USA AND UK GOVERMENT TO PLS TAKE IT SERIOUS IF YOU CONSIDER YOUR SELF THAT YOU HAVE BEST HUMAN RIGHTS IN YOUR COUNTRIES. PLS VISIT UAE SPECIALLY SHARJAH. PLEASE CHECK UAE BANKS POLICIES AGAINST BANK LOANS AND CREDIT CARDS. BANKS ARE NOT CENTRALIZED, FIRST THEY GIVE HIGH AMOUNTS AS LOANS AND CREDIT CARDS TO PEOPLE AND THEN THEY DESTROYED THEIR ENTIRE LIFE. THEY SIMPLY PUT THE PEOPLE INTO THE JAILS. THEY DO NOT CARE THAT THE PERSON IS DOING JOB, LIVING WITH HIS FAMILY, KIDS GOING TO SCHOOL AND IMMIDIATELY THEY OPEN POLICE CASE AGAINST THE DEFAULTER EVEN THE DEFAULTER HAS ALREADY IN BAD FINANCIAL CRISES AND HAS LOSS HIS JOB DUE TO SOME REASON. MOST OF THE DEFAULTERS ARE INNOCENT AND DUE TO BAD GLOBAL FINANCIAL CRISES THEY ARE NOT ABLE TO PAY THE MONTHLY LOAN INSTALMENTS. POLICE CATHING THE INNOCENT PEOPLE ON THE AIR PORTS, ON THE ROADS, FROM HOME AND OFFICES. THEN IF THE FAMILY MEMBERS CAN PAY SOME AMOUNT TO THE BANK THEN AFTER LONG TIME THE GIVE RELEASE TO THE PRISONER. IF THE DEFAULTER HAS NO ANY FRIENDS AND RELATIVE THEN HE HAS TO STAY IN JAIL FOR LONG TIME AND AFTER UAE POLICE SENDS HIM OUT FROM THE COUNTRY WITH EMPTY HANDED. WAOOOOOOOOOO WHAT A PLEASANT SURPRISE FOR FAMILIES. I SALUTE UAE GOVERNMENT AND I SALUTE UAE POLICE, I SALUTE UAE BANKS. THEY ARE PLAYING THE WORST ROLE IN THE WORLD.
About to leave UAE with a property mortgaged to tamweel…..I have tenants renting the house and planning on paying from abroad as well as rent……Any advise to the pittfalls?

One of my friends left UAE, Abu Dhabi with a personal loan of Dhs. 200,000/- (Two Hundred Thousand) from ADCB with out cancelling his Residence Visa and not taking his end of service benefits (it will worth about Dhs. 50,000). He is not able to repay a single fills and not willing to come back to UAE. What will happen for him. Required advice from expert and experienced members.

All in all my card outstanding is nearly AED 110,000…………. Emirates AED16000, RAK – AED 30000, Barclys – AED 20000, Najam – AED15000, ADCB- AED 25000 and Dunia – AED10000. Loan arond AED 25000.
Due to financial crisis i left dubai few months back to india and never want to go back middle east/GCC.
What can happen if i dont pay the outstandings? coz im not in a position to pay it. Getting so much conflicting reports about the banks and their actions. also about collection agencies. Banks keep calling my india number…what shall i do ….plz plz suggest.
